Idiot Judge Rules Against Direct Linking

The Robert Davis vs SFX case might just be the dumbest, court case of the year.

Here is the skinny on the case. Apparently SFX has an inept, incompetent, and most likely retarded webmaster who can’t figure out how to add one line to the .htaccess file. Since their webmaster is a worthless sack of roting lard, the mentally challenged management monkies decided to sue Davis who was providing direct links to their webcasts.

Davis knew that the case was a joke, so he didn’t even hire a lawyer. He then proceeded to totally clown himself in the courtroom, and thus the idiot judge who clearly must suffer from some sort of extremely disabling mental retardation ruled against him.

This is like a trifecta of dumb!

SFX is dumb because they couldn’t figure out how to do a simple redirect, and instead opted to go the legal route. What could have been 5 minute job for a competent webmaster, turned out into a drawn out court case, and big lawyer bills.

Davis is dumb, because he lost a case that was almost impossible to loose - especially since the very similar Ticketmaster vs. Tickets.com case had exactly the expected results - judge ruled that linking is not infringement. This case was a no brainer. So just think - how bad was his defense to make the judge rule against him?

And of course, the judge is inexplicably dumb, because if he should have known that the SFX case was absolutely baseless. But then again, if all 3 parties, taking part in a lawsuit are just plain stupid, then the resulting ruling can’t be anything but.

Where do you draw the line here? Is Davis still allowed to post URL’s to the media files? How about partial urls (like go to example.com and then /whatever/media/webcast.mpg)? How about partial URL’s shifted with rot13?

Sigh… I wonder what does this ruling mean to the internet as a whole…

The $100 Xbox Sale Killed Amazon Servers

You might have noticed that the widely hyped $100 Xbox sale at Amazon did not go as planned. Under the combined effect of digg, slashdot and many simillar sites, their servers buckled, caught on fire and died. It’s a shame. One would think that a multi-million dollar company which makes thousands of transactions per second all over the world would anticipate something like this. I mean, lets look at what was happening here:

  1. you are selling an Xbox for half free
  2. on a national holiday when everyone is likely to be home
  3. during the pre-christmas buying frenzy
  4. with a small limit, meaning everyone will try to get it the minute it goes live
  5. digg and other websites linked to your sale

Knowing all of this how could you not anticipate some very heavy traffic? It’s a shame!

I initially kinda wanted to do this, but then I overslept. When I woke up I decided I don’t even care enough to check if they are still available.

Oh well…

Peter Jackson is not doing The Hobbit

Peter Jackson said he will not be involved in the production of The Hobbit. Apparently PJ did not want to commit to do the movie until his lawsuit against New Line is resolved. He was offered a settlement in exchange for his commitment to the project but he resented the use of the movie as a bargaining chip and he refused. Consequently, the studio told him to suck it, and decided to get someone else.

As the end result, I don’t know if The Hobbit will be even remotely watchable. With Jackson a the wheel we knew that we could expect the same amount of awesome as in the LOTR trilogy. Will his replacement stay true to PJ’s vision? Will he stay true to the book?

If you read the article, they also mention a LOTR prequel that is distinct from The Hobbit. For me that looks like a big can of WTF just waiting to happen. What would be the content of this prequel? Which Tolkien stories will they base it on? I sure hope they are not planning to write some original content loosely based on Middle Earth history and wrap it up in LOTR branding. That would essentially be like pulling off another Highlander 2. One would think that Hollywood has learned something from that disaster…

Bank of America: Victims of Check Fraud Will Be Arrested

This story is beyond disturbing. How the hell can you run a bank if you let things like this happen?

Some dude apparently sold a bike on Craigslist and got paid with a odd looking check. When he went to cash it in at his local Bank of America branch he asked the teller to see if it is legit. The teller called police, and the guy was held at gunpoint, thrown on the floor, cuffed, thrown into jail and then release at a hefty bail. All of this because he was given a phony check by some internet fraudster.

If you have a BoA account, you probably should cancel it and move to a different bank which will not treat you like a criminal. If you do, remember to send Mark Frauenfelder at Boingboing an email - he is keeping a tally of how much money the bank is loosing because of this incident.

Internet is…. Not for Porn?

According to the latest study posted on slashdot, pr0n constitutes only 1% of the available, searchable Internet content. I am totally stumped!

Here we all thought that the internet is for porn, but it turns out that it is not! Holly friken doodles!

This is actually a really, really good ratio of smut to content if you ask me. Which leads me to this:

Sorry - it had to be done. All those jerkoffs that get on their high horse claim they don’t watch pr0n piss me off. If you are to dumb to get free smut on the web, to perverted to be turned on by the sickest shit that the net has to offer, or to wrapped up in your stupid religion to even think about sex, it does not mean you have right to regulate our masturbatory activities… Er… I mean, our entertainment.

Anyways, pr0n is not the problem - it’s just a minuscule 1% of the information available out there. I know that it seems more but that’s because you probably spend to much time downloading it and searching for it. P

Btw, if you RTFM you will see that this study is probably not the most accurate, revealing or thorough one. So yeah - grain of salt, people. I just never miss an occasion to insult the pr0n hating prudes.
